Every state follows pretty much the same requirements for getting a replacement title but the procedures for running the gauntlet are different. A vehicle title (or a car title) is a legal form, establishing a person or business as the legal owner of a vehicle. Vehicle titles in Texas are issued by the Texas Department of Transportation.

The certificate of title normally specifies:

Identifying information about the vehicle,normally at minimum its vehicle identification number, make, and year of manufacture.
Technical information about the vehicle to define its taxation regime, such as its gross vehicle weight and motive power.
The name and address of the purchaser or"registered owner" who would normally possess and use it.
If money is owed on the vehicle, the name of the lien holder or "legal owner" to whom this money is owed.
When a vehicle is financed, the certificate of title is normally held by the lender, who must release it to the purchaser once the balance is paid off. When a car is sold from one owner to another, the title must be transferred to the new owner. This is achieved by requesting approval by the Texas DOT.

Title Issuing State: Yes beginning in 1939 titles have been issued in TX. All types of vehicles are titled except trailers and semi-trailers with a gross weight of 4,000 pounds or less, trailers and semi-trailers with a gross weight of 34,000 pounds or less used solely for the transportation of farm products with farm plates. More exceptions and restrictions apply.

The third part is the Surety Company. They are the entity who will be insuring the principal of the obligations referenced in the Bond Form.

Surety Bonds

We know that several states require that a Title Bond be purchased in order to issue a new title...for their protection! Here's how it works. The state will determine the value of the car in question, let's say $5000. The purchaser will then have a bonding service issue a Title Bond and the cost is dependent on the car's history, the length of time the bond is good for and the purchaser's credit history.
The agency issuing the Title Bond is insuring the state issuing the new title, that if during a length of time, usually one to six years, if the original title owner appears and wants their car, new title owner will give the vehicle back or write a check for $5000, regardless of the car's condition.
So before you sign on the dotted line to purchase a title bond, you better be 100% certain, like that the car wasn't stolen because no matter how much time and money you put into this newly titled car, it can go back to the previous owner without a penny coming your way.
When an individual needs to register a vehicle that was legally purchased and the title or transfer of title was neither misplaced or never provided, a title bond is required by the State of Texas Department of Motors Vehicles to release a title to the individual requesting the registration and title of said vehicle. These bonds are often referred to as title bonds, DMV bonds, car bonds, and certificate of title bonds.
The title bond protects the State of Texas Department of Motor Vehicles, and any and all purchasers of the vehicle covered by the bond. This bond protects any lien holder or rightful owner of said vehicle if a title is released to someone who is not the legal owner of that vehicle. Title Bonds are generally issued within two weeks of the application being submitted to VIP Title Service.

Titles issued by the state indicate a car's legal status and record of ownership. However, you may purchase a vehicle that doesn't have a title. To prove ownership, you must apply for what most states refer to as a bonded title.


Bonded titles, or surety bonds, require assurance that the car you bought doesn't have a problematic background and serve to protect the issuing state from future hassles. If someone later comes along and claims they still own the car you want to title, the bond pays for the state's insurance deductible.
Antiques and rebuilt vehicles, personal imports and even homegrown motor vehicles qualify for bonded status. If you simply walk into a dealership, or buy from an individual, you normally won't need this kind of title.


Should you buy a car with no title or are given one, make sure you have proof of that, or at least contact info for the person who gave you the vehicle. The state then runs a check to verify the car isn't stolen or has any liens on it, so the VIN must be intact and traceable. Cars from out of state may require lengthier processing since the Department of Motor Vehicles needs to contact authorities elsewhere.


Bonded titles don't limit your ability to sell the car nor impact its record, as in the case of liens. The bonded status also has a time limit on it--usually 3 years. Most states do not sell bonds directly. You'll need to go to an insurance agent or currency exchange. Finally, bonded titles are not exclusive to any one state; almost every state can issue them.


Bonded titles work in your favor. Since you don't have a title at the start, previous ownership remains uncertain. Should someone sue you for ownership of the car and win, the bonding entity pays for any associated costs.

Branded vehicle titles

A vehicle with a branded title has either a different-colored title with a notation on it or a notation at the bottom of a regular-looking title to differentiate it from a clean title.

Title brands vary by state and can include the following types:

Rebuilt Title – This is a vehicle that was previously branded as “salvage” but has been repaired and inspected. Even though these vehicles may be driveable, the rebuilt title permanently documents the vehicle as having been, at one time, a salvage vehicle. Bad credit lenders will not finance a salvage branded vehicle.

Salvage Title– This is a vehicle that has been damaged and would, according to state law, usually cost between 75% and 100% of its value to be repaired. In some states, the rebuilt brand does not exist and salvage vehicles that have been repaired still carry the salvage brand on their titles. Bad credit lenders will not finance a salvage vehicle.

Flood Damaged Title – This is a vehicle that has been damaged by water. A flood damaged vehicle can also be classified as a salvage or junk vehicle in many states. Bad credit lenders will also not finance a flood damaged vehicle.

Junk Title – a vehicle that can only be sold for scrap or used for parts

Fleet Title – Although usually not a brand, most states require that any vehicle that has been used as a taxi, for a daily rental or in police use be designated as a fleet vehicle. Lenders may or may not finance a fleet vehicle.

Mileage unknown – Mileage unknown is not a brand, but most states require that a title be notated if the mileage of the vehicle is not known due to an odometer replacement or other issues. May lenders will not finance a vehicle if the mileage is unknown.

Stolen Title – Like a fleet vehicle, a stolen vehicle is also usually not a brand, although many states can also refuse to title a vehicle once it has been stolen. Due to the damage often done to stolen vehicles, many are branded so that they can’t be re-sold.
